Auckland Construction Disputes Lawyers

Types of Cases Handled by Auckland Construction Disputes Lawyers

An Overview of Common Legal Matters in the Construction Sector

Introduction

Construction disputes are common, and it is one of the biggest earning sectors for Auckland law firms. When you consider all of the various inter-connected companies involved in any construction project, property owners, contractors, developers, architects, engineers, and suppliers, it is not too difficult to see why there can be a dispute somewhere. Let’s take a look at some of the types of cases that Auckland construction dispute lawyers work on.

Common Types of Construction Dispute Cases

Construction projects, whatever the size, have multiple suppliers. For major building projects, the number of services providers, increases, as does the value of each stage. Very quickly, multi-millions of dollars can be at risk.

Further, given the tight cashflows that most operators have, the need for prompt and full settlement of invoices can be critical. Building in New Zealand is largely under the Construction Contracts Act 2002. Below are common issues for Auckland construction dispute lawyers.

Contract Disputes

These disagreements can be about the terms of the contract such as payment disputes, interpretation of the meaning or intention of various clauses, and performance. Performance can be delays whether in delivery of materials, or in output of work, or variations in scope such as deviating from the agreed design or quality

Termination of contracts

Under what circumstances can a contract be terminated? Is there a performance, or a time element involved?

Payment Claims

Payment ought to be one of the most visible and easy to understand clauses in a contract. It should stipulate items such as progress payments for completed works, and retentions until the work are signed off.

Another aspect that needs to be spelled out n the contract is adjudication proceedings, i.e. how, where, and by whom will the payment dispute be viewed.

Defective Workmanship and Building Defects

Unfinished buildingDefects and the standard of workmanship are common problems. Often, they are subjective, open to interpretation, rather than having a clear measure such as a short delivery of materials which can be measured in meters, tonnes, pieces, etc.

Non-compliance with building codes and standards is an easier issue to assess but can take time to get an Auckland Council building inspector to visit the site to make the assessment.

Another type of dispute relates to the use of substandard materials.

Delay Claims

Building projects can be subject to delays resulting in financial costs. A construction disputes lawyer can review the causes of the delays and consider liability for them and negotiate time extensions or financial compensation for affected parties.

Regulatory and Compliance Issues

This can be a wide range of issues including failing to meet the requirements of the design, using non-compliant materials, and more. Lawyers can advise on matters relating to building consents, compliance with Auckland Council regulations, health and safety obligations, and environmental laws.

Negligence and Professional Liability

This area generally affects the professional service firms sub-contracting to the project. Typically this involves claims against architects, engineers, or other professionals for alleged negligence or breach of duty, resulting in project failures or defects.

Disputes with Subcontractors and Suppliers

There is a myriad of sub-contractors involved in even a small project like a house renovation. Builders, plumbers, carpenters, electricians, drainage, roofers, decorators, as well as the various material suppliers.

Disagreements can arise regarding supply of the correct materials, failing to meet agreed delivery schedules, and sub-standard quality can lead to legal action between main contractors and their subcontractors or suppliers.

Insurance Claims

Insurance claims can arise due to property damage, public liability, or builder’s warranty insurance policies.

Dispute Resolution Methods

Lawyers help clients pursue or defend claims for rectification, compensation, or remedial works. Te common dispute resolution methods are:

Negotiation, which is generally between the various lawyers of each party.

Mediation where a mediator helps the partes define the issues in the dispute, develop and explore settlement options, will act to remedy the situation.

Arbitration where an independent lawyer will make a biding judgement.

High Court is the final, most expensive, and the longest process.

Conclusion

Auckland construction disputes lawyersAuckland construction disputes lawyers work with clients to either defend or pursue a broad range of cases. These can be contract or payment issues, professional negligence, or regulatory compliance. Given the amount of potential finger-pointing with so many parties involved, it is a difficult and challenging area of law.

If you have a construction dispute of any kind, a good Auckland law form to approach is McVeagh Fleming. They have a team of lawyers who can help you with the complexities of construction law aiming to bring a resolution to their disputes.

Auckland Divorce Lawyer – Coaching And Legal Advice

December 11th Is International Break-Up Day Says An Auckland Divorce Lawyer

There are statistics for everything but one of the less happy ones is that December 11 is the most common day of the year for break-ups. Apparently, it is a time of year when couples think about separating from their spouse or partner according to an Auckland divorce lawyer.

On International Break-up Day, it’s not difficult to see why this day is spread worldwide – with the heightened pressures and stressful atmosphere during the festive season. This is further pressured in the southern hemisphere since Christmas comes is followed by the summer holiday season. For parents, there is the additional pressure of the school holidays too.

Given the volatility of emotions, the desire to avoid beginning the New Year in the same situation, is quite understandable. Then there is the added burden of all the expectations placed on romantic relationships around the holiday season. From the pressure of buying gifts, the pressure to appear to be a happily married pair, and the pressure of playing happy families. It is understandable that many couples start to doubt their marriages at this time of year.

An Auckland divorce lawyer recently spoke about data from Stats NZ revealed that divorce rates are rising in New Zealand and that, in the upcoming year, the number of divorces may surpass the number of weddings.

Break-upDeciding to break-up is a difficult decision. For most, it will have been a long time since they last took that step so have little experience in what to do or what happens next. Seeking neutral, professional assistance from a third-party is beneficial when deciding whether to end a relationship. The overwhelming nature of the impending changes, along with the lack of experience, means that there are frequent mistakes that people make. It is better to be prepared for what must happen next by getting advice prior to having the awkward discussion about ending the relationship.

Auckland Divorce Lawyer

It is essential to get good legal advice as soon as you can, preferably even before you have that difficult conversation with your partner.  This way, you will be armed with solid information rather than relying on ideas from well-meaning friends. There will be inevitable emotional throwback so being armed with facts rather than friendly support, will stand you in good stead.

An Auckland Divorce Coach

Another aspect to consider is coaching though a divorce.  While the legal side is important, just as crucial is your understanding, expectations, and ways forward. A divorce coach can give you the support you need to help you work though this difficult time in your life.

Divorce is a multimillion-dollar industry that profits from difficult, protracted, and psychologically demanding separations. Whatever of the reasons for your separation, divorce doesn’t have to be this way.

Auckland divorce lawyerSeparating the legal challenges from the emotional and day-to-day tasks can be difficult. It is important to discern between these two since they require different approaches. Thus, it helps to look at both the legal and emotional issues separately in order to address each of them more effectively. A divorce coach who is also legally qualified seems like the right answer.

For people considering a break-up from their partner, it can pay dividends to seek coaching before you start the process to prepare you for what lies ahead. If that coach is an Auckland divorce lawyer too, then you will be in fine hands. Reset Coach could be a good place to start.

Auckland Real Estate Lawyer – Help And Advice – House Purchase

Protect Your Investment, Talk to An Auckland Property Lawyer

Owning a home is probably the biggest financial step of most people’s lives. Given today’s housing market prices, this can be an even more daunting obstacle to overcome.

Do not buy a problem house. If you are contemplating buying one, go to see an Auckland residential property lawyer first and make sure that all aspects of the contract have been satisfied before signing on the dotted line.

Make The Buying Process Easier And Less Stressful

No matter how experienced you are as a property buyer, any real estate transaction is frustrating. There is lots of paperwork which requires attention to detail. The contract in most cases is the standard Auckland District Law Society Sale and Purchase Agreement. However, it still needs to be read through if one party adds any extra clauses.

Talk To A Real Estate Lawyer Before Signing Any Agreements

Picking the right lawyer is essential to ensuring a smooth transaction when buying property. If you’re about to buy a house in Auckland, make sure that you talk with an NZ qualified residential property lawyer first.

Auckland real estate lawyerThe process of purchasing land can be scary and confusing if it is your first time or even as an expert purchaser. As such, it pays off immensely for any prospective buyer – especially those looking at houses in Auckland – to get professional legal advice before signing anything official.

The numbers say that you’re probably paying a million dollars but over the life of your mortgage, you could be spending two million. That’s why it makes sense to spend just a little bit more money with an Auckland real estate lawyer to verify that everything is safe before signing on the dotted line.

The New Finance Clause

People have used a financing clause as get-out option if they change their mind about a property. Typically, people would say that if they were not able to get financing by a certain date, their offer was no longer valid. People cannot do that any longer.

The buyer has to show proof from their potential lender that they could not get finance. This must be a letter, an email or another formal document from the lending institution.

What Actions Does An Auckland Residential Property Lawyer Actually Do?

For starters, they are there to protect you. The lawyer will do this by providing expert legal advice and knowing the process inside-out. That means less time wasted worrying about potential problems with your purchase. They will be independent so that any emotion you may have is removed from proceedings too.

The lawyer will check the Title Deed to confirm that the seller has all legal rights to sell the property. They will check the Land Information Memorandum (LIM) report, which highlights potential risks including drainage issues related to the land you want to buy.

In addition to checking that the seller has legal right to sell, they will ensure all of your concerns have been addressed. They want you to be confident in any purchase.

Once all the details are verified, the solicitor will manage the transfer of funds from the lender to the seller’s lawyer. They will then confirm the LINZ that you are the new owner and the Title Deed will be changed to show that.

For any property transactions in the Auckland area, McVeagh Fleming can help. They have a good team of property lawyers in Auckland. You can get more details from their website mcveaghfleming.co.nz

St Johns Home Renovations – 3 Common Types

The Three Most Common Major St Johns Home Renovations

When it comes to renovating a home one of the most important things to ask yourself is how you will benefit from doing so. The two most common reasons that people choose to take this action is to either improve their quality of life when they are enjoying their home and increasing the value of the home so it is worth more when it is time to sell it. Oftentimes both reasons apply. For both of these reasons there are three most common areas of the home that are renovated. Here you will learn more about these common major St Johns home renovations and the ways in which they can benefit you.

St Johns home renovationsOne of the most common areas of the home that people choose to renovate is the kitchen. The kitchen is often seen as the heart of the home. A great deal of time is spent in this space preparing meals, baking, socializing with the family and friends and, of course, it is a space that is cleaned often. Due to how useful a kitchen is, it can be an ideal space in which to get creative. This can include everything from the types of cabinets, counter tops, back splashes and appliances that are installed. Each of these items can make the space more efficient as well as easier to maintain. Additionally, due to the fact that a kitchen is to integral in a home, having the very best of appliances and other features can significantly increase the value of the home. When done right, the value can increase far more than the money that is spent on improving it. It is easy to see why a kitchen upgrade is a common St Johns home renovations project.

The second most common space to renovate is the bathroom. Again, this is a space that is used a great deal. However, what can make a bathroom unique is that it can also be a space in which you can have privacy and use as a source of relaxation. Using renovations to enhance its functionality as well as increase its ability to help you to relax can greatly increase your quality of life. This can be anything from temperature-controlled water, various types of shower heads, large bathtubs or whirlpools or just the general aesthetics of the room. Also like the kitchen, when planned well, the value that can be added to the home can be far greater than the expense that is put into the project itself.

The third most common is the addition of a room to the home. This can be either by adding on space to the home or creating a functional living space out of an existing part of the home, such as the attic or basement. This is one of the highest value-added renovations as you are increasing the technical square footage of the home with relatively little cost. Even the most basic of amenities can significantly increase value and, of course, improve the enjoyment of the home for all that live there. There really is no set way that this has to be done in order to achieve either goal.

Now that you know the three most common types of renovation you are ready to consider which one would be ideal for you to tackle. Remember to consider not only the added value, but how it can improve your lifestyle in the meantime as well.

If you live in the St Johns area an are thinking about a major home renovation, Fever Pitch is a good renovations builder to try.
